Terms of Service

These Terms of Service ("Terms") govern your access to and use of Marcenta ("the Service"), operated by Marcenta ("we", "us", or "our"). By accessing or using Marcenta, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Beta product

Marcenta is currently in private beta. The Service is provided as-is for evaluation and early access purposes. During the beta period:

  • Features may change, be added, or be removed without notice
  • We do not guarantee any uptime, availability, or service level
  • Data may be lost or reset during development and testing
  • The Service is provided free of charge during the beta period

We will provide reasonable notice before transitioning from beta to a paid service.

2. Eligibility and accounts

You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or your organisation. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You agree to provide accurate information when creating your account and to keep it up to date.

3. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service to process data you do not have the right to process
  • Resell, sublicense, or commercialise the Service without our written permission
  • Interfere with or disrupt the integrity or performance of the Service
  • Use automated tools to scrape or extract data from the Service

4. Your data

You retain all ownership of the marketing data you connect to Marcenta. By using the Service, you grant us a limited licence to process your data solely for the purpose of providing the Service to you.

We do not sell your data or use it to train AI models without your explicit consent. You are responsible for ensuring you have the right to connect and process any data you bring into Marcenta.

5. Intellectual property

The Service, including all software, designs, algorithms, and content created by Marcenta, is owned by us and protected by intellectual property laws. Nothing in these Terms transfers any ownership of our intellectual property to you. You may not use our name, logo, or trademarks without our prior written consent.

6. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARCENTA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100 USD IF YOU HAVE NOT MADE ANY PAYMENTS.

8. Termination

You may stop using the Service at any time. We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion.

Upon termination, your right to use the Service ceases immediately. We will delete your data within 30 days of account termination unless required by law to retain it.

9. Governing law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through good faith negotiation. If negotiation fails, disputes shall be subject to binding arbitration.

10. Changes to these terms

We may update these Terms from time to time. We will notify you of significant changes by email or by posting a notice in the product. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
